Background:
Plaintiff, David Collier, brought this action against employer Ingram Barge Co. under the Jones Act and LHWCA, Longshore Harbor Workers' Compensation Act.

Collier alleged he is a seaman who worked for Ingram as a crew member and has sued Ingram for negligence under the Jones Act, unseaworthiness under general maritime law, and §905(b) of the LHWCA.

Background:
Plaintiff, Scott Lamberger ("Lamberger"), was a seaman employed by Inland Marine Service Inc. ("Inland"). Lamberger was injured while moving a 55 gallon drum aboard one of Inland Marine's vessels, and entered into a Settlement and in turn agreed not to sue and granted indemnification to Inland.

Lamberger received $53,500 in exchange for agreeing to the following: "Scott Lamberger does herby release, covenant not to sue, aquit, and forever discharge, hold harmless, protect, indemnify, and defend Inland Marine Service, Inc., its vessels, barges and equipment etc...". Furthermore, included was a promise not to sue under the Jones Act or any kind of general maritime law pertaining to or referring to unseaworthiness of navigable vessels, gave up the right to maintenance and cure also.

Background:
Plaintiff, Nasser Aljalham ("Nasser") filed this Jones Act case against his former employer, American Steamship Company ("American") as a result of back injuries Nasser received while loading groceries on the vessel.

The Court set a discovery cutoff date of March 31, 2009. American, after this date, moved for leave to file a third party complaint through which is sought third party indemnification, contribution, and other relief from Alloue Marine Supply.
