Background: Razo, a citizen of the Phillippines ws employed on the cruise ship M/V Empress of the Seas. Royal Caribbean ("Caribbean") was the operator and bareboat charterer of the M/V Nordic Empress.
Razo claimed that he was injured during a lifeboat drill and brought various claims against numerous parties in NJ state court, including Jones Act and unseaworthiness against Royal Caribbean and Nordic.

Background: An employee filed a petition for damages against his employers under the Jones Act. The employers and their insurer responded by filing a motion for summary judgment seeking a judgment that the employee's sole remedy was under the Longshoreman & Harbor Workers' Compensation Act. Thus, the employers and their insurer stated the employee's claims under the Jones Act should be dismissed.
